The terms and conditions governing your use of the Locke Energy Solutions / LockeOS website and service-request process.

1. Acceptance of Terms

By accessing or using the LockeOS website (the “Site”) operated by Locke Energy Solutions (“we,” “us,” or “LockeOS”), or by submitting a service request through our forms, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.

These Terms form a binding agreement between you and Locke Energy Solutions, a Florida-based solar and HVAC contractor serving Palm Beach County. The Site is offered subject to your acceptance, without modification, of all of the terms and conditions set forth below.

2. Scope of Services

Locke Energy Solutions is a licensed Florida solar and HVAC contractor. The work we perform under a signed proposal, work order, or service agreement generally falls into these categories:

Our proposals spell out exactly which items are included. Things that are not included unless explicitly written into your proposal include: electrical service-panel upgrades beyond what is needed for the new equipment, structural repairs (rotted roof decking, framing, drywall), pest remediation, mold remediation, painting, and finish work after our trades are done. We pull the permits we are required to pull as the contractor of record; HOA and architectural-review approvals remain the customer's responsibility.

3. Service Area

Our primary service area is Palm Beach County, Florida. We regularly work in Wellington, West Palm Beach, Lake Worth, Palm Beach Gardens, Boynton Beach, Delray Beach, Jupiter, and Royal Palm Beach, and we accept jobs throughout the rest of Palm Beach County as schedule allows.

Properties outside our primary service area — for example, in Broward or Martin County — may still be served, but typically require a travel-fee quote added to the proposal to cover drive time and same-day return trips if a follow-up is needed. We'll always tell you up front whether a travel fee applies before you sign anything.

There are two layers of warranty on most Locke Energy Solutions projects, and it's useful to know which is which:

Warranties — ours or the manufacturer's — do not cover: damage from acts of nature (hurricanes, lightning, flooding, falling trees); damage you or a third party caused after we finished (roof leaks from later work, modifications to the system by someone other than Locke, impact damage); deferred maintenance (a system we told you needed service and you didn't schedule); or normal wear and consumable items (filters, fuses, refrigerant top-offs outside a covered leak repair).

We reserve the right to suspend or terminate access (including rejecting future service requests) for anyone who engages in prohibited use.

8. Intellectual Property

The Site and all of its content — including text, graphics, logos, photographs, illustrations, case studies, calculator tools, code, layout, and design — are owned by Locke Energy Solutions, our licensors, or our service providers and are protected by United States and international copyright, trademark, and other intellectual-property laws.

You may view and use the Site for personal, non-commercial reference only. You may not reproduce, republish, distribute, modify, or create derivative works without our written permission, except as expressly permitted (e.g., sharing a link to a page on social media, or quoting brief excerpts with attribution).

Your service-request submissions: When you submit information through our service-request form, you grant Locke Energy Solutions a limited, non-exclusive license to use that information for the purposes described in our Privacy Policy — primarily to respond, schedule, perform, and follow up on the requested work. We will not publish your name, address, or identifying details in testimonials, case studies, or marketing without your separate written consent.

9. No Professional Advice

Informational content on the Site — including savings estimates produced by our calculators, system-size recommendations, energy-production forecasts, FAQ answers, blog posts, and case studies — is provided for general informational purposes only. It is not a substitute for a site-specific engineering assessment, professional engineering review, or on-site evaluation.

Solar production, HVAC efficiency, energy savings, and system sizing depend heavily on variables that can only be confirmed in person — roof condition, orientation and shading, electrical service capacity, structural load, local codes, current FPL rates, and your actual consumption patterns. Final specifications, equipment selection, and pricing always require an on-site visit and a written proposal from Locke Energy Solutions.

10. Third-Party Links & Services

The Site may link to third-party websites for your convenience — for example, FPL's efficiency programs, Angi reviews, DSIRE incentive databases, federal tax-credit resources, or utility rebate portals. These links are provided as references, not endorsements. We do not control those sites and are not responsible for their content, accuracy, or availability.

11. Disclaimers & Limitation of Liability

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content.

We do not warrant that the Site will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Site or its servers are free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided on the Site.

Savings figures, production estimates, and ROI projections shown anywhere on the Site are illustrative only. Actual results depend on conditions we cannot fully predict at the time of publication. We do not guarantee any specific savings, payback period, or kWh production.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCKE ENERGY SOLUTIONS AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Because use of the Site is free, our total cumulative liability for any claim arising under these Terms is limited to the greater of: (a) the amount you have paid to Locke Energy Solutions through the Site in the twelve months preceding the claim, or (b) zero U.S. dollars (US $0). This limitation applies to the maximum extent permitted by Florida law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Locke Energy Solutions, its officers, employees, contractors, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any applicable law or third-party right.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from or related to the Site, these Terms, or any service performed by Locke Energy Solutions will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

Nothing in these Terms limits any non-waivable rights you have under Florida law as a consumer.

14. Changes to These Terms

We may update these Terms from time to time. The “Effective” date at the top of this page shows when the current version took effect. For significant changes (such as new restrictions on use, expanded liability limitations, or new user obligations), we will attempt to notify active customers by email where possible. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
